CRIMINAL BACKGROUND CHECKS

FOR ALL FMYSA VOLUNTEERS

Thank you for your interest in volunteering with the Flower Mound Youth Sports Association. FMYSA is an all-volunteer, non-profit corporation providing youth softball and baseball programs in the Greater Flower Mound area. One of our primary goals is to continually ensure the safety of our membership.

In 2002 , The Flower Mound Town Council passed legislation requiring all town sanctioned youth sports associations to conduct criminal background checks of all persons acting as head coaches, board members, and any other person acting in an official capacity with the organization directly overseeing children. The Town of Flower Mound further requires that these background searches be completed at least every three years. In accordance with this legislation, The Flower Mound Youth Sports Association has developed the following policy regarding all volunteers, including all coaches, directors, volunteers, and administrators.

All persons desiring to participate in the Flower Mound Youth Sports Association as a Head Coach, Director, or Executive Board Member shall complete a FMYSA VOLUNTEER APPLICATION. In addition, beginning Fall 2008 , all persons who serve as an ASSISTANT COACH for recreational softball or for a select baseball or select softball team shall complete an FMYSA VOLUNTEER APPLICATION, which includes a background check. FMYSA defines “assistant coach” as any person who is in uniform and/or inside the fences during games. FMYSA Executive Board will be considering the idea of reviewing Assistant Coaches at a future date .  In addition, each person shall consent to a personal criminal background search completed by a reputable company licensed by the State of Texas to conduct such searches. Information obtained from these searches shall be available to FMYSA Executive Board Members only and shall remain confidential at all times. The Flower Mound Youth Sports Association shall pay the cost of each search. The FMYSA Executive Board of Directors shall have the final decision on all FMYSA personnel matters.

(Effective Spring 2009, all assistant coaches in baseball and softball recreational leagues and all assistant coaches for baseball and softball select teams will be required to consent to a criminal background check.)

 

A person will be disqualified and prohibited from serving as a volunteer in the Flower Mound Youth Sports Association if the person:

1. Fails to consent to a personal criminal background search; or
2. Has been convicted (including crimes whereby a plea of "no contest" was entered) of a crime of child abuse, sexual assault, child neglect, murder, voluntary manslaughter, felony assault, arson, robbery, burglary, indecent exposure, public lewdness, terroristic threat, any offense against a minor, kidnapping, or felony violations of the Controlled Substance Act; or
3. Has been twice convicted, in any combination, of the following offenses: Misdemeanor Assault, or any violation of the Controlled Substance Act.
4. Has been twice convicted, in any combination during the past seven years, of the following offenses: Driving While Intoxicated (DWI) or Driving Under Influence (DUI); or
5. Has been adjudged liable for civil penalties or damages involving sexual or physical abuse of children; or
6. Has been subject to any court order involving any sexual abuse or physical abuse of a minor, including but not limited to domestic order for protection; or

FLOWER MOUND YOUTH SPORTS ASSOCIATION DOES NOT DISCRIMINATE AGAINST ANY PERSON, OR PERSONS, BASED ON AGE, RACE, GENDER, RELIGION, NATIONALITY, OR ETHNICITY.

ADDENDUM TO FMYSA VOLUNTEER APPLICATION FORM

1. I have never been convicted (including crimes where a plea of "no contest" was entered) of a crime of child abuse, sexual assault, child neglect, murder, voluntary manslaughter, felony assault, arson, robbery, burglary, indecent exposure, public lewdness, terroristic threat, any offense against a minor, kidnapping, or felony violation of the Controlled Substance Act?
2. I have not been twice convicted, in any combination, of the following offenses: Misdemeanor Assault, or any level violation of the Controlled Substance Act.
3. I have not been twice convicted, in any combination during the past seven years, of the following offenses: Driving while Intoxicated (DWI), or Driving Under Influence (DUI).
4. I have never been adjudged liable for civil penalties or damages involving sexual or physical abuse of children?
5. I have never been subject to any court order involving any sexual abuse or physical abuse of a minor, including but not limited to, domestic order for protection?
6. I hereby authorize the Flower Mound Youth Sports Association and/or its authorized agent to conduct a criminal background check of my personal history for purposes of evaluating my ability to serve as a volunteer with the organization.
